Declaratory Judgement Sought Against Bike Ban PDF Print E-mail

With the financial and moral assistance of Houston area cyclists, a lawsuit filed earlier this month challenges the wisdom and legality of the bike ban in Hunter's Creek Village.

Cause number 2000-62582, Brian D. Reese vs. City of Hunter's Creek Village, was filed in the District Court of Harris County, Texas, 127th Judicial District (Judge Sharolyn Wood) on December 8, 2000.

The suit says that the narrow, poorly designed and poorly maintained HCV "paths" are dangerous to use, exposing "operators of vehicles comprising bicycles" and other path users like baby carriages to an unreasonable risk of serious bodily injury and death. Instead of improving the safety of roadway users, the mandatory sidepath law has the exact opposite effect, the suit alleges.

The suit seeks declaratory judgment ordering the "BICYCLES ON ROADWAY PROHIBITED" signage to be removed.
